IMPORTANT NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER (SECTION 16). THEY AFFECT YOUR LEGAL RIGHTS. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS OF FIRST ACCEPTING THESE TERMS BY FOLLOWING THE PROCEDURE IN SECTION 16. PLEASE READ CAREFULLY.

1. Introduction and Acceptance

Welcome to SnapRepairPro. These Terms of Service (the "Terms") form a binding legal agreement between you and SnapRepairPro ("SnapRepairPro," "we," "our," or "us") and govern your access to and use of our websites, mobile applications, AI-powered diagnostic tools, contractor-matching features, and any related services (collectively, the "Platform").

By creating an account, uploading a photo, submitting a project, or otherwise accessing or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

SnapRepairPro is a software platform. We are not a licensed contractor, home inspector, engineer, electrician, plumber, or building official. We do not perform repairs, inspections, or construction work of any kind.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Platform. By using the Platform, you represent that you meet these requirements. The Platform is not directed to children under 13, and we do not knowingly collect information from children under 13.

3. Description of the Services

3.1 AI Diagnostic Guidance

The Platform allows you to upload photographs and descriptions of household issues. Our AI then generates suggested diagnoses, repair plans, materials lists, difficulty scores, and step-by-step instructions (collectively, "AI Output").

AI Output is provided for informational and educational purposes only. AI Output is generated automatically by machine-learning models, may be incomplete, outdated, or inaccurate, and is not a substitute for inspection or advice from a licensed professional, your local building department, or your municipal code official.

You acknowledge that:

  • AI Output is not professional advice. It is not engineering advice, legal advice, electrical advice, plumbing advice, structural advice, or a code-compliance determination.
  • Photographs alone cannot reveal hidden conditions such as mold, asbestos, lead paint, knob-and-tube wiring, structural defects, gas leaks, or concealed water damage.
  • You are solely responsible for evaluating whether a project is appropriate for do-it-yourself ("DIY") work and for deciding whether to proceed.
  • Certain repairs (including but not limited to most electrical, gas, plumbing, structural, roofing, and HVAC work) require permits, inspections, or a licensed professional under state and local law. You are solely responsible for determining and complying with all applicable permit, code, licensing, and safety requirements.

3.2 Pro Network and Contractor Matching

The Platform may, now or in the future, facilitate connections between homeowners and independent third-party contractors and tradespeople ("Pros"). Where contractor information is displayed, it is drawn from publicly available state contractor licensing board data and other public sources. We do not independently verify, endorse, supervise, employ, or guarantee any Pro.

Any agreement, transaction, or relationship between you and a Pro is solely between you and that Pro. SnapRepairPro is not a party to that agreement. We do not warranty, guarantee, or insure the work of any Pro. We do not employ Pros, and Pros are not our agents, partners, joint venturers, representatives, or franchisees. Pros are independent businesses.

You are responsible for verifying a Pro's license, insurance, bonding, references, and qualifications before hiring. You are responsible for the scope of work, pricing, payment, safety, and outcome of any engagement with a Pro.

3.3 Changes to the Services

We may add, modify, suspend, or discontinue any feature of the Platform at any time, with or without notice. We are not liable to you or any third party for any such change.

4. Accounts and Account Security

Certain features require an account. You agree to provide accurate and current registration information and to keep it updated. You are responsible for all activity that occurs under your account and for safeguarding your credentials. Notify us promptly of any unauthorized use. We may suspend or terminate your account at our discretion for any violation of these Terms or for any reason, with or without notice.

5. User Responsibilities and Acceptable Use

You agree that you will:

  • Provide accurate information and photographs that fairly represent the actual condition you want analyzed.
  • Use the Platform only for lawful, personal, non-commercial purposes, unless you have a separate written agreement with us.
  • Comply with all applicable laws, building codes, electrical codes, plumbing codes, permit requirements, and safety standards.
  • Take appropriate safety precautions before attempting any repair, including shutting off power, gas, and water as needed and using proper personal protective equipment.

You agree that you will NOT:

  • Use the Platform for any work where you are not legally permitted to perform the work yourself.
  • Misrepresent the condition, location, or ownership of the property you are submitting.
  • Scrape, crawl, harvest, reverse-engineer, decompile, or attempt to derive the source code, model weights, prompts, or training data of the Platform or any AI system used by it.
  • Access or use any application programming interface (API), automated endpoint, or backend service of the Platform except through interfaces and credentials we expressly authorize.
  • Use bots, scripts, or other automated means to submit photographs, queries, or other content.
  • Upload content that is unlawful, infringing, defamatory, obscene, contains malware, or violates the rights of any third party (including photographs taken without permission of an occupant or owner).
  • Use AI Output to train, fine-tune, or evaluate any competing artificial-intelligence model or product.
  • Resell, sublicense, or commercially exploit the Platform or AI Output without our prior written consent.

6. Your Content and License to Us

You retain ownership of the photographs, descriptions, and other content you submit to the Platform ("User Content"). You represent and warrant that you have all rights necessary to submit your User Content and that doing so does not violate any law or third-party right.

You grant SnapRepairPro a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, display, modify, create derivative works of, and use your User Content (a) to operate, provide, and improve the Platform, including generating AI Output for you; (b) to develop, train, fine-tune, and evaluate machine-learning models in a manner that does not associate the content with you personally; and (c) for any other purpose disclosed in our Privacy Policy. This license survives termination of your account with respect to content you have already submitted.

You may request deletion of your User Content as described in our Privacy Policy. We may retain copies as required by law, for legitimate business purposes, or in backup systems.

7. AI-Specific Disclaimers

THE AI OUTPUT IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO REPRESENTATION OR WARRANTY THAT AI OUTPUT IS ACCURATE, COMPLETE, RELIABLE, CURRENT, ERROR-FREE, OR SUITABLE FOR ANY PARTICULAR REPAIR OR PROPERTY.

AI Output is not a diagnosis. It is not a code-compliance determination. It is not a substitute for a licensed inspector, contractor, engineer, or your local permitting authority. You are responsible for verifying any AI Output before relying on it, purchasing materials based on it, or performing work based on it. You assume all risk arising from your decision to follow, modify, or disregard AI Output.

8. Intellectual Property

The Platform, including all software, designs, text, graphics, AI models, prompts, logos, and the "SnapRepairPro" name and marks, is owned by SnapRepairPro or its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for your personal, non-commercial use. All rights not expressly granted are reserved.

9. Third-Party Services and Links

The Platform may contain links to or integrations with third-party services, websites, retailers, or contractors. We do not control those third parties and are not responsible for their content, products, services, pricing, availability, or practices. Your dealings with any third party are solely between you and that third party.

10. Fees and Payment

Certain features of the Platform may be offered for a fee. If you purchase a paid feature, you authorize us (and our payment processor) to charge the payment method you provide. All fees are non-refundable except as required by law or as expressly stated at the point of purchase. We may change pricing at any time on a going-forward basis.

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM, AI OUTPUT, AND ANY CONTRACTOR INTRODUCTIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THE WORK, QUALITY, SAFETY, LICENSING, INSURANCE, BACKGROUND, OR HONESTY OF ANY CONTRACTOR OR PRO LISTED ON OR INTRODUCED THROUGH THE PLATFORM.

Some jurisdictions do not allow the exclusion of certain warranties. To the extent such exclusions are not permitted where you reside, the exclusions above apply only to the maximum extent permitted by law.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SNAPREPAIRPRO, ITS OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR PROPERTY; OR FOR ANY PERSONAL INJURY, DEATH, FIRE, FLOOD, ELECTRICAL DAMAGE, GAS DAMAGE, STRUCTURAL DAMAGE, OR OTHER DAMAGE TO PROPERTY OR PERSONS, ARISING OUT OF OR RELATING TO (A) YOUR USE OF OR INABILITY TO USE THE PLATFORM; (B) YOUR RELIANCE ON ANY AI OUTPUT; (C) ANY DIY WORK YOU PERFORM; OR (D) THE ACTS, OMISSIONS, WORK PRODUCT, OR CONDUCT OF ANY CONTRACTOR OR PRO INTRODUCED THROUGH THE PLATFORM, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (I) THE TOTAL AMOUNT YOU PAID TO SNAPREPAIRPRO IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent such limitations are not permitted where you reside, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless SnapRepairPro and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms or any applicable law; (d) any DIY work you perform or fail to perform; or (e) any dispute between you and a contractor, Pro, retailer, or other third party.

14. Termination

You may stop using the Platform at any time and may close your account by contacting us. We may suspend or terminate your access to the Platform, in whole or in part, at any time, with or without cause and with or without notice. Upon termination, the provisions that by their nature should survive (including Sections 6 through 13, 15, 16, and 17) will survive.

15. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws principles. Subject to Section 16, you and SnapRepairPro agree to the exclusive jurisdiction and venue of the state and federal courts located in Multnomah County, Oregon, for any dispute not subject to arbitration.

16. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION.

Except for (a) small-claims-court matters within that court's jurisdiction; (b) disputes about the scope, enforceability, or validity of this Section 16; or (c) actions to enjoin infringement of intellectual property rights, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in Multnomah County, Oregon, or, at your election, by telephone or videoconference.

YOU AND SNAPREPAIRPRO EACH WAIVE THE RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY FORM OF CLASS PROCEEDING.

30-Day Opt-Out.You may opt out of this arbitration agreement by sending written notice to legal@snaprepairpro.com with the subject line "ARBITRATION OPT-OUT," including your full legal name and the email address associated with your account, within thirty (30) days of first accepting these Terms. Opting out does not affect any other provision of these Terms.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms with a new "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Platform after the changes take effect constitutes your acceptance of the updated Terms.

18. Miscellaneous

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, are the entire agreement between you and SnapRepairPro regarding the Platform. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign these Terms freely. Nothing in these Terms creates an agency, partnership, employment, or joint-venture relationship between you and SnapRepairPro.
